Terms of Service

1. Who we are

The Services are operated by Bizgrapes Platforms (SMC-Private) Limited (“Bizgrapes,” “we,” “us”), registered in Pakistan. These Terms are a contract between you and Bizgrapes.

2. Eligibility

You must be at least 18 years old to create an account or use Bizgrapes AI. By using the Services, you confirm you meet this requirement. We do not knowingly allow accounts belonging to anyone under 18.

3. Your account

• You’re responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• One account per person. Creating multiple accounts to work around usage limits is a violation of these Terms (see Section 5).
• You’re responsible for activity that happens under your account, whether or not you personally performed it.
• Let us know immediately at support@bizgrapes.com if you believe your account has been compromised.

4. Acceptable use

Bizgrapes AI is built to help you build and run a brand or small business. To keep it usable and fair for everyone, you agree not to:

• Use the Services to generate or share content that’s illegal, defamatory, hateful, sexually explicit involving minors, or that infringes someone else’s intellectual property or privacy.
• Use the Services to harass, threaten, impersonate, or deceive another person or business.
• Attempt to reverse-engineer, scrape, decompile, or extract the underlying models, prompts, or source code behind the Services.
• Resell, sublicense, or provide third-party access to the Services (for example, running it as a backend for someone else’s product) without our written permission.
• Use bots, scripts, or other automation against the app outside of its intended chat interface.
• Create multiple accounts, or use another person’s account or device, to bypass free-tier limits (message caps, design-generation caps, or any other usage limit). We may reasonably treat accounts sharing strong duplicate signals — same device, same payment method, near-identical usage pattern immediately after a cap is hit — as a single account for enforcement purposes.
• Attempt to make the assistant bypass its own safety guidelines, or use it to generate content that violates Anthropic’s own usage policies, since Bizgrapes AI is built on Anthropic’s Claude API.
• Interfere with the normal operation of the Services, including attempts to overload, disrupt, or gain unauthorized access to our systems.

5. Suspension and termination

We’d rather warn you than ban you. Our default approach is a warning first, with a real ban only for repeat or serious violations, but some conduct is serious enough to warrant immediate action without warning.

5.1 Warning first, for minor violations

For a first-time, non-malicious violation of Section 4 — for example, minor free-tier gaming, spammy message flooding, or an honest first-time misuse — we’ll typically send a warning explaining what happened and what needs to change. A second violation of the same kind, or continued conduct after a warning, may lead to a temporary suspension or permanent ban.

5.2 Immediate suspension or ban, no warning required

We may suspend or permanently ban an account immediately, without prior warning, for:

• Generating or attempting to generate illegal content, including content sexualizing minors.
• Harassment, threats, or abuse directed at Bizgrapes staff or other people.
• Payment fraud, chargebacks made in bad faith, or other financial abuse.
• Security exploitation, attempted unauthorized access, or attempts to disrupt the Services.
• Reselling or providing unauthorized third-party access to the Services.

5.3 What happens on suspension or termination

• We may limit, suspend, or delete your account and any associated content.
• An active paid subscription is not automatically refunded on termination for cause; see Section 6 for our refund policy.
• You can appeal a suspension or ban by emailing support@bizgrapes.com with your account email and a description of what happened. We review appeals but aren’t obligated to reverse an enforcement decision.
• You may also close your own account at any time from Settings in the app.

6. Subscriptions, billing, and refunds

Paid plans are billed through Google Play Billing. Your subscription, cancellation, and payment details are managed through your Google Play account.

Canceling a subscription stops future renewals but doesn’t itself trigger a refund for the current billing period; you’ll keep access until the period ends. Google Play’s own refund mechanisms, and its 48-hour buyer-initiated refund window, operate independently of this policy and are outside our control.

7. Content and intellectual property

• You own the content you input into Bizgrapes AI (your prompts, briefs, and uploaded images) and, subject to these Terms, the designs and text the assistant generates for you.
• You’re responsible for making sure you have the rights to anything you upload (logos, images, brand assets).
• Bizgrapes retains all rights to the Services themselves, including the app, website, GrapeScore, our brand, trademarks, and underlying code and design system.
• Content published to the public Bizgrapes AI Designs Gallery becomes visible to other users and the public, per the Gallery’s own publish settings inside the app.

8. AI-generated content disclaimer

Bizgrapes AI uses Anthropic’s Claude models to generate suggestions, copy, brand feedback, and designs. AI output can be wrong, generic, or not commercially usable as-is. GrapeScore’s audit and any AI feedback are directional guidance, not professional legal, financial, or trademark advice. You’re responsible for reviewing generated content, including for trademark conflicts, before you publish or use it commercially.

9. Disclaimers and limitation of liability

The Services are provided “as is,” without warranties of any kind, express or implied. To the maximum extent permitted by law, Bizgrapes isn’t liable for indirect, incidental, or consequential damages arising from your use of the Services, including business decisions made based on AI-generated output. Nothing in these Terms limits liability where the law doesn’t allow it to be limited.

10. Changes to these Terms

We may update these Terms as the Services evolve. We’ll update the “Last updated” date above when we do. Continued use of the Services after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Pakistan. Any dispute arising from these Terms or the Services will be subject to the courts of Pakistan.
